Sunset Beach Retreat sleeps up to 12 people. Two Bedrooms have King size beds, and the third bedroom has four Full size bunk beds. We require that all reservations provide the following information prior to booking. 1) The Names and Ages of All Guests. 2) Home address. 3) Cell number. 4) Email address. ***Note***Only guests listed by you at the time of booking will be allowed on site. Note* Any young children or infants are considered guests and will be counted toward the maximum occupancy. Photo IDs may be required upon request No bait or cleaning of fish on site. Please no eating in bedrooms. Must use Outdoor shower after beach, before entering pool or home. KEEP DOORS CLOSED. Front and rear entry doors must be kept closed during your stay. Check in 4PM Firm, Check out 10AM Firm Guest Records on File. Upon request, all Guests shall be required to place an active cell phone number and a valid driver’s license, or other government issued identification, on file with the host. Guests shall provide the legal names and ages of all guests upon booking. Age Requirements - All Guests entering into this Agreement must be at least 25 years of age. Occupants - Only the occupants specifically identified above in this Agreement shall occupy the Premises. No Student Groups - Student groups are prohibited from renting the Premises. Use of the Property - Use of the Premises is strictly limited to private residential vacation activities only. Guests agree and acknowledge that they are granted a license to use the Premises, that their use is seasonal and temporary, and that no form of tenancy has been created pursuant to Chapter 83 of the Florida Statutes. Maintenance - Guests accept the Premises in “as-is” condition with no warranties or promises expressed or implied. Owner and its hosts shall be responsible for maintaining the Premises unless damage is caused by Guests. Animals - NO ANIMALS are allowed on premises. In the event Guests have an animal on the premises, said guests will be immediately removed from the property with all monies forfeited and applicable Animal/Pet cleaning fees applied. Smoking - Smoking is not permitted in the Premises. Smoking is not permitted on patios or any outdoor spaces. Smoking is only permitted roadside. Please dispose of cigarettes properly. Additional cleaning fees to be applied if evidence of smoking on premises. Risk of Loss - Personal property of the Guests and their invitees shall be in the Premises at the sole risk of Guests. Owner and its hosts shall not be liable for any damage caused to said personal property. Assignment - Guests shall not assign this Agreement of sublet the Premises or any part thereof. Substitution of Accommodations - Circumstances may cause the Premises to be unavailable, including the Owner deeming the Premises unavailable. In such event, Owner reserves the right to substitute comparable accommodations. Right to Refuse Occupancy and Removal of Guests - If Guests violate any of the terms and conditions of this Agreement, all monies collected shall be forfeited and Guests may be summarily removed with the assistance of a Florida law enforcement officer in compliance with Section 509.141(4) of the Florida Statutes. Additionally, in accordance with Section 509.401 of the Florida Statutes, if Owner or its agents upon a reasonable determination determine Guests have accumulated a large outstanding account, Owner or its agents may lock the Guests out of the Premises for the purpose of requiring Guests to confront the Owner or its agents and arrange for payment on account. Other Remedies. In addition to the foregoing rights and remedies of Owner under this Agreement, Owner expressly reserves all other rights and remedies available to similar parties pursuant to Florida law, including those available pursuant to Chapter 509 of the Florida Statutes. Attorney’s Fees - Should it become necessary for Owner or its hosts to employ an attorney to enforce the terms and conditions of this Agreement, Guests shall be responsible for all costs and attorneys fee. Radon Gas - Radon Gas is a naturally occurring radioactive gas that, when it is accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon and radon testing may be obtained from the county public health unit. Owner and its agents make no representations about the existence of radon gas in the Premises. Use of Equipment - Guests agree that they use the equipment provided by Owner, including but not limited to bicycles, stand-up paddleboards, kayaks, pool, sauna, cold plunge, golf cart at their own risk and assume all risk of injury, illness, damage or loss that may result from such use. Guests agree to obey and act in compliance with all applicable Florida, DMV, and Coast Guard law, including the Coast Guard laws pertaining to use of personal flotation devices, when using the equipment provided by Owner. Guests shall not permit any third-parties to use the equipment, and, if such use is permitted by Guests, Owner may terminate Guests rental and retain all monies collected as liquidated damages. WAIVER and RELEASE of LIABILITY/INDEMNIFICATION - Guests release and discharge Owner, including its hosts, owners and related entities, from and against any and all claims for injuries or damages resulting from Guests’ use of the accommodations or equipment. Guests agree that they will indemnify and hold harmless Owner, including its hosts, owners and related entities, for all personal injuries and damages to any and all third parties arising from such third party’s use of the accommodations and/or equipment at the direction of, under the supervision of or with the consent, express or implied, of Guests’. The parties stated on the rental reservation consent to all the terms of this agreement when booking through Airbnb.
